Law PACT Act - Bill To Ban Vapes Shipping Through USPS

I received an email from PuffItUp regarding this and thought I should pass it along. Today is the last day that we can write to our representatives and try to change this........ I encourage all of you to do so.

But we truly need your help guys n gals. On Monday there is a Bill that will be voted on by congress. It passed unanimously in the Senate and gets sent to the House of Reps on Monday. The Bill is S.1253

This Bill will BAN vapes from shipping through USPS. Only UPS, and FedEx will be able to be used.

What does this mean for small businesses?

Small Businesses like artisan vape manufacturers will no longer be able to use USPS, and will have to register as a business in all 50 states. This costs TIME, and MONEY. Two things artisan vapes generally don't have.

Companies we love will not be able to do this. This could mean the end to their businesses. The end of you being able to purchase their vaporizers.

What does this mean for YOU?

It means that vapes will be more expensive due to shipping. FedEx and UPS are usually double or triple the cost of USPS, and often slower as well.

If you live in a rural area, you will not be able to purchase vapes through the mail anymore. UPS and FedEx hand off mail to USPS in rural areas. If this bill goes into effect, this can no longer happen.

How can you help?

Call your representatives! Email them too! Don't be a Karen. Be civil, and nice. Let them know that you oppose the bill, and why you do. Tell them your story. Help their interns connect with you and fight for your rights. They are there to represent you.

Tell your friends! Ask them to kindly email and call your local reps, and share their stories.

We aren't going to shill on this email. Please go out and share your stories with your local reps, lets make change happen. We only have this weekend to change history.

This is truly asinine and I attribute it mainly to two facts: 1) our politicians are way better at 5 second sound bites than grasping actual details and distinctions and; 2) the term "vape" is almost meaningless anymore as it covers a huge range of very different devices delivering very different products for very different uses.

This is shameful.
 
Can they not just be re categorised as like a solid matter heating device..
Id be looking for loopholes and grey areas here....
What classifies something as a vape???
A kettle contains a heating element and vapourises water no??? Whats the difference...
Gotta be some solicitors looking into this surely.....
 
With the USPS vape ban looming, will companies mark up their current inventory or are we going to see a shit ton on sales in the coming weeks from vendors? Genuinely curious what everyone thinks?

Going with sales because UPS and FedEx have followed suit. According to this vape company blog, USPS has until April 26, 2021 to come up with its own regulations for enforcing the shipping ban. So after that, it seems likely that few if any options will exist to ship vape products to individuals. Companies that depend on that business could be forced to liquidate.

That's already happening in the nicotine sector. Vape companies were required to submit premarket tobacco product applications (PMTAs) for all of their products by September 9 of last year. (A federal court forced FDA to set a May deadline which was extended due to COVID.) Less than 200 companies complied. FDA has already sent the first 11 letters to companies that did not, telling them that continued sale of their vape products is illegal. Those companies have largely ceased operations.

It's worth noting that under the Tobacco Control Act and implementing regulations, devices intended for cannabis (e.g. DT's atomizers) are legally tobacco products and subject to regulation. FDA's enforcement priorities are focused on tobacco use initiation by young people, so these products are probably well down FDA's list. But IMO, including these devices in the definitions of tobacco products was intentional.

PIU (RANDY) is likely just temporarily reducing/discounting stock in order to maximize his capital fluidity until he sees how things shake out with USPS and the other carriers. If the margins remain decent with new carrier fees then he will likely continue his business...likely his and other businesses like his will attempt to pass the new shipping cost on to the consumer as well as the wholesalers. We may even see more drop shipping as well.

I managed to order a PCKT 2 and multiple pieces and parts (a huge box of goodies) for my Sai and Sequoia before this passed. Some should arrive today. I’m so disappointed about this law.

People with power over us combined with an agenda and a poorly thought out plan. It’s just awful and it will never go away.
 
any new news on this ... will this vape ban destroy the entire vaporizer industry ? they do not sau directly that Dry herb vaporizersw are effects just some wierd ( advanced refillable personl use devise ) ... all for more taxes and sin tax added to cannabis because of all the harms associated with tobacco use ... so frustrating an Stupid
 
Did a quick Google search this morning to see if I could come up with any information on current status of how the PACT Act will affect us. Found an article from the end of February with some interesting info in it; specifically this blurb:

However, there now appears to be a kernel of hope for vapers—at least for a fairly large number of vapers. A partnership between a private group buying company and a national residential shipping carrier known simply as X has begun building a vaping product delivery network that will serve residential customers in some areas, with more to follow. There are currently more questions than answers about which areas will be covered and which vape companies will be able to participate, but the folks at X seem dedicated to making it happen.
Shipping costs will be slightly higher, but not far from the cost of USPS delivery with adult signature collection. However, the considerable costs retailers will incur because of PACT Act and tax compliance, and rejigging all of their shipping processes, will probably be reflected in the prices we pay for products and shipping.

The goal is to cover as many customers as possible right away, then to continue growing the coverage area after launch.
“This is a very competitive market, so companies are going to try to meet customers’ needs without going bankrupt,” American Vaping Association president Gregory Conley told Vaping360. Minimum order sizes to receive free shipping will likely increase, according to Conley. And product selection may thin out as large retailers look for ways to streamline their operations.
The X delivery coverage area has not been made public yet, but according to one seller who intends to ship through X, it is likely to cover parts of more than a dozen states as of April 1. The coverage area at launch is expected to include at least sections of Florida, Texas, California, Nevada and Arizona. A spokesman for X declined to confirm specifics about delivery areas, but told Vaping360 that it would soon provide a list arranged by ZIP code (the coverage isn’t defined by state borders).

I see names being changed and middle men quitting but what I don't see happening is vape makers stopping making and selling vapes.
I could be wrong but where there's demand........there's gonna be supply.

The alphabets may start raiding and arresting as we have the author of the 94 crime bill as pres and a notoriously corrupt DA as vice who both are now saying they are against federal legalization and Feinstein wrote the bill so no one to stand up for us at all it seems........left cheek, right cheek.
 
Kinda sounds like that if the manufacturer's Vape contains electronics, (ENDS) then as the last PACT amendment stands now, they are all going to banned by U.S. shippers. Vaporizers like Dynavap and NOMAD and other non-electronics may, for the time being, skate by?

The FEDS really fucked this one up royally!
